Cloudflare provides a content delivery network with DNS that is available worldwide. As a result, the information transfer that occurs between your browser and our website is technically routed via Cloudflare’s network. This enables Cloudflare to analyze data transactions between your browser and our website and to work as a filter between our servers and potentially malicious data traffic from the Internet. In this context, Cloudflare may also use cookies or other technologies deployed to recognize Internet users, which shall, however, only be used for the herein described purpose.

The use of Cloudflare is based on our legitimate interest in a provision of our website offerings that is as error free and secure as possible (Art. 6(1)(f) GDPR).

Data transmission to the US is based on the Standard Contractual Clauses (SCC) of the European Commission. Details can be found here: https://www.cloudflare.com/privacypolicy/.

For more information about Cloudflare’s security precautions and data privacy policies, please follow this link: https://www.cloudflare.com/privacypolicy/.

This privacy policy explains what information we collect and how we use it. It also explains how and for what purpose the information is collected.

You should be aware that there are inherent security risks in transmitting data over the Internet (e.g., when communicating by e-mail). It is not possible to completely protect data from access by third parties.

Information about the responsible party (referred to as the “controller” in the GDPR)

The data controller of this website is:

DYNAMICNORD GmbH
Pettenkoferstraße 12
83052 Bruckmühl / Germany

Phone: +49 (0) 8061 3898330
E-mail: info@dynamicnord.com

The data controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Retention duration

Unless a more specific retention period is specified in this Privacy Policy, we will keep your personal information until the purpose for which it was collected no longer applies. If you make a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, deletion will take place after these reasons cease to apply.

General information on the legal basis for the data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9 (2)(a) GDPR, if special categories of data are processed according to Art. 9 (1) DSGVO. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 (1)(a) GDPR. If you have consented to the storage of cookies or to the access to information in your end device (e.g., via device fingerprinting), the data processing is additionally based on § 25 (1) TTDSG. You may withdraw your consent at any time. If your data is required for the fulfilment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, if your data is required for the fulfilment of a legal obligation, we process it on the basis of Art. 6(1)(c) GDPR. Furthermore, the data processing may be based on our legitimate interest according to Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

Information about data transfer to the USA and other non-EU countries

Among other things, we use tools of companies domiciled in the United States or other from a data protection perspective non-secure non-EU countries. If these tools are active, your personal data may potentially be transferred to these non-EU countries and may be processed there. Please be aware that these countries may not provide a level of data protection comparable to that in the EU. For example, U.S. companies are required to share personal information with the security authorities and you, as the data subject, have no recourse in a court of law. Therefore, it cannot be ruled out that U.S. authorities (e.g. the Secret Service) may process, analyse and permanently archive your personal data for surveillance purposes. We have no control over these processing activities.

Withdrawing your consent to data processing

A wide range of data processing activities are only possible with your explicit consent. You may also revoke any consent you have already given us at any time. This will not affect the lawfulness of any data collection that occurred prior to your revocation.

Right to object to data collection in specific cases; right to object to direct marketing (Art. 21 GDPR)

IN THE EVENT THAT DATA ARE PROCESSED ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION. THIS ALSO APPLIES TO ANY PROFILING BASED ON THESE PROVISIONS. IN ORDER TO DETERMINE THE LEGAL BASIS ON WHICH ANY DATA PROCESSING IS BASED, PLEASE REFER TO THIS PRIVACY STATEMENT. IF YOU REGISTER AN OBJECTION, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED, UNLESS WE ARE ABLE TO PROVIDE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING OF YOUR DATA WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR IF THE PURPOSE OF THE PROCESSING IS THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF THE PERSONAL DATA CONCERNED FOR THE PURPOSE OF SUCH MARKETING. THIS ALSO APPLIES TO THE CREATION OF A PROFILE IN CONNECTION WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects are entitled to lodge a complaint with a supervisory authority, in particular in the member state where they usually maintain their domicile, place of work or at the place where the alleged violation occurred. The right to lodge a complaint is independent of any other administrative or judicial procedure available as a legal remedy.

Right to data portability

You have the right to request that we provide you or a third party with any data that we process automatically on the basis of your consent or for the performance of a contract, in a commonly used machine-readable format. If you request the data to be transferred directly to another controller, this will only be done if it is technically feasible.

Information about rectification and erasure of data

In accordance with the applicable statutory provisions, you have the right at any time to demand information about your archived personal data, their source and recipientsy as well as the purpose of the processing of your data. You may also have a right to have your data rectified or eradicated. If you have questions about this subject matter or any other questions about personal data, please do not hesitate to contact us at any time.

Right to request restrictions on processing

You have the right to request restrictions on the processing of your personal data. You can contact us at any time. The right to request restrictions on processing applies in the following cases:

  • In the event that you dispute the accuracy of your data held by us, we will normally need some time to investigate your claim. While this investigation is underway, you have the right to request that we restrict the processing of your personal data.
  • If the processing of your personal data has been or is being carried out in an unlawful manner, you have the right to request that we restrict the processing of your personal data instead of requesting that it be erased.
  • If we no longer need your personal data and you need it to exercise, defend or claim legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.
  • If you have made an objection pursuant to Art. 21(1) GDPR, your rights and our rights must be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to request a restriction of the processing of your personal data.
  • If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

For security reasons and to protect the transmission of confidential content, such as purchase orders or inquiries you submit to us as the website operator, this website uses either an SSL or a TLS encryption program. You can recognize an encrypted connection by checking whether the address line of the browser switches from “http://” to “https://” and also by the appearance of the lock icon in the browser line.

If the SSL or TLS encryption is activated, data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If you are required to provide us with your payment information (e.g. bank account number if you give us a debit authorisation) after entering into a fee-based contract with us, this information will be required to process payments.

Payment transactions using popular payment methods (Visa/MasterCard, direct debit from your bank account) will only be processed using encrypted SSL or TLS connections. You can recognize an encrypted connection by checking whether the address line of the browser switches from “http://” to “https://” and also by the appearance of the lock icon in the browser line.

If the communication with us is encrypted, third parties will not be able to read the payment information you provide to us.

Refusal of unsolicited e-mails

We hereby object to the use of the contact data published in connection with the obligatory data in our site notice to send us advertising and information material that we have not expressly requested. The operators of this website and its pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as SPAM messages.

You can set your browser to notify you each time a cookie is placed and to only accept cookies in certain cases. You may also choose not to accept cookies in certain cases or in general, or you may choose to delete cookies automatically when you close your browser. If cookies are disabled, the functionality of this website may be limited.

If third party cookies are used or if cookies are used for analytical purposes, we will inform you separately in connection with this Privacy Policy and, if applicable, ask for your consent.

The information you provide in the contact form will remain with us until you ask us to delete it, revoke your consent to its retention, or if the purpose for which the information is retained no longer exists (e.g. after we have completed our response to your inquiry). This is without prejudice to any mandatory legal provisions, in particular retention periods.

6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. For the handling of the newsletter, we use newsletter service providers, which are described below.

Klick-Tipp

This website uses Klick-Tipp for the sending of newsletter messages. The provider is KLICK-TIPP LIMITED, 15 Cambridge Court, 210 Shepherd’s Bush Road, London W6 7NJ, United Kingdom.

Klick-Tipp is a service that allows us, for instance, to organize and analyse the sending of newsletters. The data you have entered for the purpose of subscribing to the newsletter, are stored on Klick-Tipp’s servers.

Data analysis by Klick-Tipp

If we send newsletters with the assistance of the Klick-Tipp service, we can see whether a newsletter message has been opened and which links were clicked, if any.

Klick-Tipp also allows us to divide our newsletter subscribers into different categories (this is called “tagging”). For example, we can divide newsletter subscribers based on gender, personal preferences (e.g., vegetarians, carnivores, etc.) or customer relationship (e.g., existing customer or potential customer). As a result, we can more effectively custom tailor our newsletters to the respective target groups. For more information, please follow these links: https://www.klicktipp.com and https://support.klicktipp.com/.

If you do not want to permit an analysis by Klick-Tipp, you must unsubscribe from the newsletter. We provide a link for you to do this in every newsletter message.

Legal basis

The data is processed based on your consent (Art. 6(1)(a) GDPR). You may revoke any consent you have given at any time by unsubscribing from the newsletter. This shall be without prejudice to the lawfulness of any data processing transactions that have taken place prior to your revocation.

Great Britain is considered a secure non-EU country as far as data protection legislation is concerned. This means that the data protection level in Great Britain is equivalent to the data protection level of the European Union.

Storage period

The data deposited with us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter or the newsletter service provider and deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data stored for other purposes with us remain unaffected.

After you unsubscribe from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist, if such action is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). The storage in the blacklist is indefinite. You may object to the storage if your interests outweigh our legitimate interest.

For more details, please consult the Data Protection Regulations of Klick-Tipp at: https://www.klicktipp.com/datenschutzerklarung/.

7. Plug-ins and Tools

YouTube with expanded data protection integration

Our website embeds videos of the website YouTube. The website operator is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the expanded data protection mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. Nevertheless, this does not necessarily mean that the sharing of data with YouTube partners can be ruled out as a result of the expanded data protection mode. For instance, regardless of whether you are watching a video, YouTube will always establish a connection with the Google DoubleClick network.

As soon as you start to play a YouTube video on this website, a connection to YouTube’s servers will be established. As a result, the YouTube server will be notified, which of our pages you have visited. If you are logged into your YouTube account while you visit our site, you enable YouTube to directly allocate your browsing patterns to your personal profile. You have the option to prevent this by logging out of your YouTube account.

Furthermore, after you have started to play a video, YouTube will be able to place various cookies on your device or comparable technologies for recognition (e.g. device fingerprinting). In this way YouTube will be able to obtain information about this website’s visitors. Among other things, this information will be used to generate video statistics with the aim of improving the user friendliness of the site and to prevent attempts to commit fraud.

Under certain circumstances, additional data processing transactions may be triggered after you have started to play a YouTube video, which are beyond our control.

The use of YouTube is based on our interest in presenting our online content in an appealing manner. Pursuant to Art. 6(1)(f) GDPR, this is a legitimate interest. If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25 (1) TTDSG, insofar the consent includes the storage of cookies or the access to information in the user’s end device (e.g., device fingerprinting) within the meaning of the TTDSG. This consent can be revoked at any time.

For more information on how YouTube handles user data, please consult the YouTube Data Privacy Policy under: https://policies.google.com/privacy?hl=en.

Vimeo Without Tracking (Do-Not-Track)

This website uses plugins of the Vimeo video portal. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.

Whenever you visit one of our pages featuring Vimeo videos, a connection with the servers of Vimeo is established. In conjunction with this, the Vimeo server receives information about which of our sites you have visited. Vimeo also receives your IP address. However, we have set up Vimeo in such a way that Vimeo cannot track your user activities and does not place any cookies.

We use Vimeo to make our online presentation attractive for you. This is a legitimate interest on our part pursuant to Art. 6(1)(f) GDPR. If a respective declaration of consent was requested (e.g. concerning the storage of cookies), processing shall occur exclusively on the basis of Art. 6(1)(a) GDPR; the given consent may be revoked at any time.

Data transmission to the US is based on the Standard Contractual Clauses (SCC) of the European Commission and, according to Vimeo, on “legitimate business interests”. Details can be found here: https://vimeo.com/privacy.

For more information on the handling of user data, please consult Vimeo’s data privacy policy at: https://vimeo.com/privacy

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter referred to as “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to determine whether data entered on this website (e.g., information entered into a contact form) is being provided by a human user or by an automated program. To determine this, reCAPTCHA analyses the behaviour of the website visitors based on a variety of parameters. This analysis is triggered automatically as soon as the website visitor enters the site. For this analysis, reCAPTCHA evaluates a variety of data (e.g., IP address, time the website visitor spent on the site or cursor movements initiated by the user). The data tracked during such analyses are forwarded to Google.

reCAPTCHA analyses run entirely in the background. Website visitors are not alerted that an analysis is underway.

Data are stored and analysed on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the protection of the operator’s websites against abusive automated spying and against SPAM.

Based on this data, the probability of non-payment is determined. If the likelihood of non-payment is excessive, we may reject the respective payment term.

Our social media presence

Data processing through social networks

We maintain publicly available profiles on social networking sites. The individual social networking sites we use are listed below.

Social networks such as Facebook, Twitter etc. can generally analyse your user behaviour comprehensively if you visit their website or a website with integrated social media content (e.g., like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered. In detail:

If you are logged in to your social media account and visit our social media site, the operator of the social media portal may associate this visit with your user account. Under certain circumstances, your personal data may be collected even if you are not logged in or do not have an account with the social media portal in question. In this case, the information may be collected through cookies stored on your device or by logging your IP address.

The information collected in this way can be used by social media site operators to create user profiles that store your preferences and interests. This allows you to see interest-based advertising within and outside of your social media presence. If you have an account with the social network, interest-based advertising can be displayed on any device where you are or have been logged in.

Please also note that we cannot retrace all processing operations on the social media portals. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social media portals. Details can be found in the terms of use and privacy policy of the respective social media portals.

Legal basis

Responsibility and enforcement of rights

If you visit one of our social media sites (e.g., Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit. In principle, you can exercise your rights (access, rectification, deletion, restriction of processing, data portability and complaint) both against us and against the operator of the social media portal in question (e.g. Facebook).

Please note that despite the shared responsibility with the social media portal operators, we do not have full control over the data processing operations of the social media portals. Our ability to do so is limited by the corporate policies of each provider.

Retention period

The data collected directly from us via the social media presence will be deleted from our systems as soon as you ask us to delete it, you revoke your consent to the storage or the purpose for which it was stored no longer applies. Stored cookies will remain on your device until you delete them. Mandatory legal provisions - in particular retention periods - remain unaffected.

We have no control over the retention period of your data, which is stored by the social network operators for their own purposes. For details, please contact the social network operator directly (e.g. in their privacy policy, see below).

Integration of the Trusted Shops Trustbadge / other widgets

If you have given your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, Trusted Shops widgets are integrated on this website to display Trusted Shops services (e.g., trust badges, collected reviews) and to offer Trusted Shops products to buyers after an order.

The Trustbadge and the associated services are offered by Trusted Shops SE, Subbelrather Str. 15C, 50823 Cologne ("Trusted Shops"), with whom we are jointly responsible for data protection according to Art. 26 GDPR. In the context of this data protection declaration, we inform you below about the essential contractual content in accordance with Art. 26(2) GDPR.

As part of the joint responsibility between us and Trusted Shops, please primarily contact Trusted Shops for privacy-related queries and to exercise your rights, using the contact options provided in the privacy information. However, you may always contact the responsible party of your choice. Your request will then, if necessary, be forwarded to the other responsible party for a response.

Data processing when integrating the Trustbadge / other widgets

The Trustbadge is provided by a U.S.-based Content Delivery Network (CDN) provider.
An adequate level of data protection is ensured by an adequacy decision of the EU Commission, which can be found here for the USA. Service providers from the USA are generally certified under the EU-U.S. Data Privacy Framework (DPF). More information is available here. If service providers are not certified under the DPF, standard contractual clauses have been agreed upon as an appropriate safeguard.

When the Trustbadge is accessed, the web server automatically stores a server log file containing your IP address, the date and time of access, the volume of data transferred and the requesting provider (access data). The IP address is anonymised immediately after collection, so that the stored data cannot be linked to you personally. The anonymised data is primarily used for statistical purposes and error analysis.

Data processingafter completion of the order

If you have given your consent, the Trustbadge will access the order information stored on your device (order total, order number, and possibly purchased product) and your email address after the order has been completed. Your email address is hashed using a one-way cryptographic function. The hash value is then sent together with the order information, to Trusted Shops pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR. This is done to check whether you are already registered for Trusted Shops services. If so, further processing will take place in accordance with the contractual agreement between you and Trusted Shops. If you are not yet registered for the services or do not agree with the automatic recognition via the Trustbadge, you have the option to register for the services manually or to complete the protection as part of an existing user agreement.

For this purpose, the Trustbadge accesses the following information stored on your device after you complete your order: order total, order number and email address. This is necessary to provide you with buyer protection. The data is only transmitted to Trusted Shops if you actively decide to conclude the purchase protection by clicking on the corresponding button in the so-called Trustcard. If you decide to make use of the services, the further processing is governed by the contractual agreement with Trusted Shops in accordance with Art. 6 para. 1 lit. b GDPR, in order to complete your registration for buyer protection, to secure your order and, if applicable, to send you review invitations by email.

Trusted Shops uses service providers for hosting, monitoring and logging. The legal basis is Art. 6 para. 1 lit. f GDPR to ensure the smooth operation of the services. Processing may take place in third countries (US and Israel).

An adequate level of data protection is guaranteed by an adequacy decision of the EU Commission, which is available here for the USA and here for Israel. Service providers from the US are generally certified under the EU-US Privacy Framework. Further information is available here. Where service providers are not certified under the DPF, standard contractual clauses have been agreed as appropriate safeguards.
